Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the HypeFolk mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. These Terms constitute a legally binding agreement between you and HypeFolk.

2. Eligibility

  • You must be at least 18 years old to use HypeFolk.
  • You must reside in one of our supported markets: Nigeria, Kenya, Ghana, or Uganda.
  • You must provide a valid phone number and complete identity verification (KYC) to access paid features.
  • You must have a valid bank account in your country of residence for receiving payments.

3. Account Registration and Security

You are responsible for maintaining the security of your account. Each account is bound to a single device via cryptographic key pairing. You agree to:

  • Provide accurate and truthful information during registration and identity verification.
  • Not create multiple accounts or share your account credentials.
  • Notify us immediately of any unauthorized access to your account.
  • Not attempt to bypass device binding, security checks, or biometric verification.

4. Platform Services

4.1 For Taskers

HypeFolk enables you ("Tasker") to earn money by completing brand placement tasks. As a Tasker, you agree to:

  • Complete tasks according to the specified requirements, including placement location, brand materials, and photo/video submission guidelines.
  • Submit authentic, original photos taken at the actual placement location. Spoofed, manipulated, or previously submitted photos will be rejected.
  • Grant precise GPS location access during submission for placement verification.
  • Not use screen capture software, photo editing tools, GPS spoofing apps, or any other means to falsify submissions.
  • Accept that submissions are subject to AI-powered verification and human review.

4.2 For Advertisers

Advertisers ("Brands") can create campaigns and tasks through the HypeFolk platform. Advertisers agree to:

  • Provide clear task requirements, valid geographic zones, and sufficient campaign budgets.
  • Fund campaigns before activation and maintain adequate budget for approved placements.
  • Not request Taskers to perform illegal, dangerous, or unethical activities.

5. Payment Terms

5.1 Tasker Earnings

  • Taskers earn the amount specified per task upon approval of their submission.
  • Payments are processed via Paystack to your registered Nigerian bank account, or via alternative payment methods for other supported markets as they become available.
  • Minimum withdrawal amounts and daily/weekly limits apply based on your account tier (Newcomer, Peer Verification, Trusted, Verified, Ambassador).
  • Withdrawals require biometric verification and may require OTP confirmation for amounts above certain thresholds.
  • Processing times vary by payment method but are typically completed within 24 hours for bank transfers.

5.2 Payment Disputes

If your submission is rejected, you may file a dispute within 48 hours. Disputes are reviewed by a different reviewer than the one who made the original decision. Dispute outcomes are final and may result in approval (with payment), partial credit (free re-submission), or upheld rejection.

6. Tier System

Taskers progress through tiers based on performance:

  • Newcomer: Default tier for new accounts with basic task access.
  • Peer Verification: Unlocked after initial approved submissions, enabling peer review tasks.
  • Trusted: Higher-value tasks and increased withdrawal limits.
  • Verified: Full KYC verified, access to premium campaigns.
  • Ambassador: Top-tier with maximum limits and priority task access.

Tiers may be adjusted based on approval rates, rejection rates, and referral activity. Excessive rejections or fraudulent behavior may result in tier downgrade or account suspension.

7. Prohibited Conduct

You agree not to:

  • Submit fraudulent, spoofed, or manipulated photos or location data.
  • Use bots, scripts, or automated tools to interact with the platform.
  • Create multiple accounts or circumvent account suspensions.
  • Attempt to reverse-engineer, decompile, or tamper with the App.
  • Engage in referral fraud, including self-referral, coordinated referral rings, or GPS proximity farming.
  • Harass, threaten, or abuse other users, reviewers, or support staff.
  • Use the platform for money laundering or any illegal financial activity.
  • Share, redistribute, or publicly post submission photos or campaign details.

8. AI Verification and Review

All submissions undergo automated AI verification that evaluates image quality, GPS accuracy, brand visibility, duplicate content, spoof detection, EXIF metadata, and content safety. You acknowledge that:

  • AI decisions may result in automatic approval, rejection, or escalation to human review.
  • The AI system uses weighted scoring across multiple verification stages.
  • Submissions flagged for fraud indicators may be automatically rejected.
  • A random sample of approved submissions undergoes additional human review for quality assurance.

9. Intellectual Property

By submitting photos and videos through the App, you grant HypeFolk a non-exclusive, worldwide, royalty-free license to use, store, process, and share your submissions with the relevant Advertiser for campaign verification purposes. You retain ownership of your original content. The HypeFolk name, logo, and application are the intellectual property of HypeFolk.

10. Account Suspension and Termination

We may suspend or terminate your account if you:

  • Violate these Terms or engage in prohibited conduct.
  • Accumulate excessive submission rejections indicating low-quality or fraudulent behavior.
  • Are flagged by our anti-fraud systems for suspicious activity.
  • Fail to complete identity verification within the required timeframe.

You may delete your account at any time through the App settings. Account deletion is subject to a 30-day grace period during which you can cancel the deletion. Pending withdrawals must be completed or cancelled before account deletion.

11. Limitation of Liability

To the maximum extent permitted by applicable law, HypeFolk shall not be liable for indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of earnings, data, or goodwill. Our total liability for any claim shall not exceed the amount you earned through the platform in the 12 months preceding the claim.

12. Dispute Resolution

Any disputes arising from these Terms shall first be addressed through our in-app support channel. If unresolved, disputes shall be submitted to mediation, and if necessary, to the courts of the Federal Republic of Nigeria, Lagos Division, which shall have jurisdiction.

13. Governing Law

These Terms are governed by the laws of the Federal Republic of Nigeria, including the Nigeria Data Protection Act 2023, the Cybercrimes (Prohibition, Prevention, Etc.) Act 2015, and applicable consumer protection regulations. For users in Kenya, Ghana, and Uganda, local consumer protection laws shall apply to the extent they provide additional mandatory protections.

14. Changes to Terms

We reserve the right to modify these Terms at any time. Material changes will be communicated via push notification and a consent prompt within the App. Continued use after notification constitutes acceptance. If you do not agree to updated Terms, you must stop using the App and delete your account.

15. Referral Program

HypeFolk offers a referral program with staged bonuses. By participating, you agree to:

  • Share referral codes only with individuals you personally know.
  • Not engage in mass distribution, paid promotion, or automated sharing of referral codes.
  • Accept that referral bonuses are subject to anti-fraud validation and may be clawed back if fraud is detected.
  • Acknowledge that referral chain depth is limited and velocity limits apply.

16. Indemnification

You agree to indemnify, defend, and hold harmless HypeFolk Technologies Ltd, its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses (including reasonable legal fees) arising out of or in any way connected with: (a) your use of the App or services; (b) your violation of these Terms; (c) your violation of any third-party rights, including intellectual property rights; or (d) any fraudulent, misleading, or unlawful submissions you make through the platform.

17. Severability

If any provision of these Terms is found to be invalid, illegal, or unenforceable by a court of competent jurisdiction, the remaining provisions shall continue in full force and effect. The invalid provision shall be modified to the minimum extent necessary to make it valid and enforceable while preserving the original intent of the parties.

18. Force Majeure

HypeFolk shall not be liable for any failure or delay in performing its obligations under these Terms where such failure or delay results from circumstances beyond its reasonable control, including but not limited to: natural disasters, acts of government, internet or telecommunications failures, power outages, civil unrest, pandemics, or disruptions to payment processing infrastructure. During any force majeure event, affected obligations shall be suspended for the duration of the event, and HypeFolk shall use reasonable efforts to mitigate the impact and resume normal operations as soon as practicable.
